Sergeant Jagne

Sergeant Adama Jagne, a member of the Gambia Armed Forces (GAF) has filed a lawsuit against the Gambia Armed Forces, the National Assembly and the Attorney General, LamToro News has learnt.

The Applicant, Sergeant Adama Jagne is demanding a compensation of D1M (one million dalasis) from two of the three respondents and an additional D200,000.00 (two hundred thousand dalasis) as Legal and Administrative cost for unlawful arrest and detention.

Sergeant Jagne was on 29th October 2025 arrested on Orders of the National Assembly Select Committee (Commission of Inquiry) into the sale of the assets belonging to the former president Yahya Jammeh. He was charged with contempt of the National Assembly for concealing information and not being truthful to the committee.

This decision was taken in pursuant to section 109 and 110 of the 1997 Constitution of the Republic of The Gambia, Order 102 and 140 of the Standing Orders of the National Assembly and the National Assembly Powers and Privileges Act.

However, Sergeant Adama Jagne (the Applicant) , on 4th November 2025, filed a lawsuit through his Lawyer Malick H.B Jallow Esq, before Justice Akinbiyi of the High Court an application of fundamental rights and freedom, against the Chief of Defence Staff of the Gambia Armed Forces (1st Respondent), Clerk of the National Assembly (2nd Respondent) and the Attorney General (3rd Respondent).

In his originating summons, the Applicant, Sergeant Adama Jagne made the following claims against the Respondents:

CDS of GAF, Lt. General Cham

#A declaration that the arrest and detention of the Applicant by the 1st Respondent on the Orders of agents of the 2nd Respondent since 29th Day of October 2025 is unlawful and violates the Applicant’s right to personal liberty as enshrined in the 1997 Constitution of the Republic of The Gambia.

Attorney General

#A declaration that the order of contempt against the Applicant made on the 29th day of October 2025 by agents of the 2nd Respondent institution without affording the applicant an opportunity to show cause prior to making the said order violates the applicant’s right o fair hearing as enshrined in the 1997 Constitution of the Republic of The Gambia.

#An order, unconditionally discharging the applicant from custody of the 1st Respondent.

#Legal and Administrative fees of GMD 200,000.00

#An order awarding a compensation of GMD 1,000,000.00 by each of 1st and 2nd Respondents to the Applicant for unlawful arrest and detention.

#Further and other Orders as the Honourable Court deems fit.

The Respondents are expected to respond within five days from the date of the application.
